Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your access to and use of BluJay131.com (the "Site"). This AUP is incorporated into our Terms of Service and all limitations of liability, indemnification, and disclaimer provisions therein apply fully to this AUP. Violation of this AUP may result in immediate suspension or permanent termination of your access, referral to law enforcement, and civil or criminal liability.
1. Scope
This AUP applies to all users of the Site, including visitors, registered users, and any automated systems, bots, or scripts accessing the Site on your behalf. By accessing the Site, you agree to comply with this AUP at all times.
2. Prohibited Conduct
You agree that you will NOT use the Site to:
2.1 Illegal Activities. Engage in, facilitate, or promote any activity that violates any applicable local, state, national, or international law, statute, regulation, treaty, or ordinance, including but not limited to laws governing privacy, data protection, intellectual property, export control, anti-spam, anti-money laundering, and anti-corruption.
2.2 Harmful or Abusive Content. Upload, transmit, display, or distribute any content that is: unlawful, threatening, abusive, harassing, stalking, tortious, defamatory, libelous, vulgar, obscene, pornographic, invasive of another's privacy, hateful, discriminatory, or otherwise objectionable.
2.3 Intellectual Property Infringement. Infringe, misappropriate, or violate any patent, copyright, trademark, trade secret, moral right, or other intellectual property or proprietary right of any person or entity.
2.4 Unauthorized Access and Security Violations. Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site, through hacking, password mining, phishing, or any other means. Probe, scan, or test the vulnerability of the Site or any connected system or network without express written authorization from BluJay131 Holdings LLC. Attempt to interfere with, disrupt, or disable the Site or any server, network, or equipment connected thereto, including through denial-of-service attacks, flooding, spamming, or any other method.
2.5 Malicious Software. Upload, transmit, or distribute any computer virus, worm, Trojan horse, time bomb, web bug, spyware, adware, ransomware, or any other harmful computer code, file, or program.
2.6 Automated and Bulk Use. Use robots, scrapers, spiders, data mining tools, or any automated means to access, index, scrape, or collect data or content from the Site without our express prior written consent. Generate or facilitate unsolicited commercial communications ("spam") through or in connection with the Site.
2.7 Impersonation and Fraud. Impersonate any person or entity, including BluJay131 Holdings LLC or its personnel; misrepresent your affiliation with any person or entity; engage in any form of identity fraud; or submit false, misleading, or fraudulent information through any form or communication channel on the Site.
2.8 Interference. Interfere with or disrupt the integrity, performance, or availability of the Site or the data contained therein. Circumvent, disable, or interfere with any security feature of the Site or any feature that prevents or restricts use or copying of any content.
2.9 Exploitation of Minors. Upload, transmit, or distribute any content that sexually exploits, abuses, or victimizes minors, or that otherwise involves or depicts minors in an inappropriate or illegal manner.
2.10 Privacy Violations. Collect, store, or disclose personal information about other users or third parties without their express consent; violate the privacy, publicity, or other personal rights of any third party.
2.11 Circumventing Terms. Use the Site in any way designed to circumvent or evade these Terms, this AUP, or any other applicable policy or legal requirement, including creating multiple accounts to circumvent a suspension or ban.
3. Inquiries and Notices
The Site's contact channel is provided solely for legitimate use cases including bug reports, legal notices, and community suggestions. Abuse of the contact channel, including submission of false, malicious, or harassing messages, is strictly prohibited and may result in immediate termination of access and referral to law enforcement where appropriate.
4. Monitoring and Enforcement
BluJay131 Holdings LLC reserves the right, but is under no obligation, to monitor use of the Site for compliance with this AUP. We may, in our sole discretion and without notice: (a) remove or disable access to any content that violates this AUP; (b) suspend or terminate your access to the Site; (c) report violations to law enforcement authorities and cooperate with investigations; and (d) pursue any other legal or equitable remedy available to us. We assume no liability for monitoring or failing to monitor the Site for AUP violations.
5. Consequences of Violation
Violation of this AUP may result in, without limitation: immediate suspension or permanent termination of your access to the Site; civil liability for damages caused to BluJay131 Holdings LLC or any third party; criminal prosecution for violations of applicable law; injunctive relief; and recovery of attorneys' fees and costs incurred by BluJay131 Holdings LLC in enforcing this AUP.
6. Indemnification
You agree to indemnify, defend, and hold harmless BluJay131 Holdings LLC and all Company Parties (as defined in the Terms of Service) from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your violation of this AUP or any applicable law or third-party rights.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUJAY131 HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM OUR ENFORCEMENT OR FAILURE TO ENFORCE THIS AUP, INCLUDING ANY DECISION TO REMOVE CONTENT, SUSPEND ACCESS, OR TAKE ANY OTHER ACTION DESCRIBED HEREIN. ALL LIMITATIONS OF LIABILITY IN OUR TERMS OF SERVICE APPLY FULLY TO THIS AUP.
8. Changes to This AUP
BluJay131 Holdings LLC may update this AUP at any time. Changes are effective upon posting. Continued use of the Site after any change constitutes your acceptance of the revised AUP.
